Reviewing a final criminal conviction through herziening

After an irrevocable conviction, the criminal case appears to be closed. In exceptional cases, revision may still make a new assessment possible. This requires more than a lasting conviction of innocence or a different reading of old evidence. A possible new finding must be connected to the statutory grounds for review and the previous ruling. Careful file analysis is therefore more important than immediately submitting an extensive request with all the old objections.

Why revision is an exceptional route

A judgment becomes final when ordinary legal remedies are no longer available or have been exhausted. Legal certainty means that not every completed case is dealt with again and again. At the same time, new information can fundamentally call into question a previous conviction. The Supreme Court describes review as an extraordinary legal remedy. The legal framework is set out in Articles 457 et seq. of the Code of Criminal Procedure. The assessment therefore starts with the question of whether a specific ground may be relevant. (Supreme Court describes review as an extraordinary legal remedy · articles 457 et seq)

Our analysis separates dissatisfaction with the old assessment from a possible new fact. Someone may rightly have many questions about a conviction without the review conditions having already been met. This requires an honest explanation, no rejection of the experience and no false guarantee of reopening. An initial investigation must determine what the judge knew at the time, how the evidence was used and what the new information actually changes. Only then will it become clear what further work is useful.

Not every new opinion is a novelty

The law mentions various grounds for review. In practice, the focus is often on a possible novelty: a fact that was not known to the judge and that may give rise to the required serious suspicion about a different outcome. That is more than the wish that a new judge weighs old material differently. A later, differently formulated argument is also not automatically a new factual element. The precise legal conditions must be assessed.

Therefore, ask each new finding what is actually new. Has an unknown document been found, has an earlier technical conclusion been undermined by new reliable information, or is an existing disagreement merely being repeated? A new expert can be valuable, but a different name under the same unchanged opinion is not automatically sufficient. The lawyer can assess the content and meaning. It is about the influence on the legal outcomes that the ground for review relates to, not just about the idea that a judge might punish less severely.

The previous evidentiary reasoning must first be clear

A review analysis requires the complete relevant old file, including judgments and any previous legal remedies. A separate incriminating piece may have played a different role in the original decision than you remember. There may have been several independent pieces of evidence or one decisive link. Without that structure, it is difficult to assess whether new information has sufficient meaning. Therefore, start with an inventory of what the judge has actually determined and motivated.

Create an evidence overview with the source and reasoning for each supporting element. Note which defenses have already been dealt with and how they were decided. This prevents a new request from becoming a repetition of previously rejected arguments. An error in a minor detail does not automatically have the same meaning as a new finding about the sole source of identification. The analysis must fairly distinguish the two. Special attention should be paid to the question of whether a document was really unknown or was already in the file but was discussed differently at the time.

Origin and reliability of the new information

A new document or file must be able to be examined for origin and integrity. Who found it, where was it kept and has it been changed? A screenshot without original context can be a reason, but often leaves questions open. A witness who gives a different statement years later requires investigation into his own perception, reason for the change and possible influence. The new character does not automatically make information reliable.

Keep originals and create a separate receipt and editing log. Do not allow witnesses to practice a desired version and do not publish a notice in which the required statement is already prescribed. A careful approach protects both the person and the evidentiary value. Independent expertise may be required for digital or forensic information. The NRGD code of conduct emphasizes accountability and independence. An expert must be able to investigate the relevant question, even when the outcome is unfavorable for the person initiating the assignment. (NRGD code of conduct)

New and important should be assessed together

A finding can be new without materially affecting the conviction. Therefore, it must be linked to the previous evidentiary decision and the legal consequences. A different departure time may be crucial for one identification, but change little if the event is supported over a broader period and by other strong evidence. A file analysis must explain that connection. The qualification alone is decisive for a new piece of writing and is not substantiation.

Work with a comparison: old observation, new information, reliability and intended consequence. Also describe what the information does not solve. That makes the assessment stronger than a one-sided list of everything that could raise doubts. The lawyer can assess whether a sufficiently detailed basis already exists or whether research is necessary first. A fair interim conclusion may be that a starting point is relevant but does not yet substantiate the legal threshold. That boundary should not be erased by outright publicity.

The PG route is different from applying for revision directly

Under legal conditions, further investigation can be requested through the lawyer from the Attorney General at the Supreme Court. The official revision explanation describes that advice and research options also exist. Access and assessment conditions must be tested specifically. A request for review is not the same as an assigned review. A positive research result must also still be processed in an appropriate application and legal assessment. (official revision explanation)

Therefore, formulate exactly which question cannot yet be answered and why the available data warrants further research. A blanket order to review the whole thing may be too unfocused. Indicate which sources exist, where material is likely to be kept and what connection is seen with a ground for review. The lawyer can assess whether the route is open and what substantiation is required. The goal is targeted research into a potentially decisive factor, not an indefinite continuation of all old disputes.

A formal application requires more than a personal letter

An application must meet legal and procedural requirements, including appropriate legal assistance and filing method. The Supreme Court describes digital litigation for review and further investigation. A general email or personal collection of documents is not automatically a complete request that will be handled in the desired manner. Have a lawyer check the current route and requirements and agree on which research question should be worked out first. (Supreme Court describes digital litigation for review and further investigation)

Costs, available documents and the scope of the assignment also deserve clear agreements. An initial feasibility analysis may be different from completely new forensic research. Ask for concrete phases and decision moments, without expecting a guaranteed reopening. A lawyer or expert should indicate the limits of the available material. The value of the work lies in a carefully assessed basis, even if the ultimate conclusion is that an application cannot be substantiated with sufficient prospects at this time.

A request does not stop a punishment by itself

A pending review application does not automatically mean that the execution of the conviction is interrupted. This may require a separate authority or decision. Let the lawyer assess what is possible in your situation and what practical consequences apply. Do not ignore a call or executive action based on your own belief that the application is strong. The final ruling remains relevant as long as the competent framework does not determine otherwise.

An approved review is also not always the same as an immediate complete acquittal. A case may be referred to another court for new hearing. Ask exactly what decision has been made and what effect it has on the previous ruling, freedom and further proceedings. The ruling and the dictum deserve separate explanation. A public notice that the case has been reopened says less than the actual legal decision. In addition, maintain care and practical support; long-term uncertainty requires a plan that does not depend solely on a hoped-for outcome.

A stalking case shows the difference between reopening and final outcome

In ECLI:NL:HR:2023:1602, the Supreme Court declared a review application in a stalking case well-founded on the basis of the new data developed and referred the case for new adjudication. The meaning is not that any later amended statement is sufficient or that revision automatically results in a final acquittal. The decision illustrates how a new finding should be connected to the original evidentiary position and why the precise legal consequence should be read. (ECLI:NL:HR:2023:1602)

For another case, the working method is particularly useful: what was supporting evidence, what was new and what serious suspicion did this create? Don't copy a conclusion without that comparison. For example, a fictitious found file that changes a timeline requires authenticity research and analysis of the role of that time in the conviction. The example of the official case provides context, not a promise of outcome. Your own application must be able to rely on its own sources, legal basis and verifiable reasoning.

A novelty card for an initial feasibility analysis

Use the card to connect a possible new finding to the old decision. Collect existing pieces without altering material or influencing witnesses. Highlight what is still just a suspicion. The card helps a lawyer specifically assess whether an investigation or an application is appropriate. It does not provide an independent right to reopening and does not replace legal requirements or specialized assessment.
