Requesting postponement of the start of imprisonment

The call to serve a prison sentence may conflict with work, a care situation or an unexpected event. However, for a self-reporter, postponement is not a normal rescheduling of an appointment. DJI describes a limited option for very urgent circumstances that someone could not take into account. Our analysis: a request must not only show that the detention is drastic, but above all why a concrete, unexpected situation requires an exceptional solution on the specified reporting date. In the meantime, it must remain clear which reporting agreement applies.

An enforceable penalty and the organization of the start

In a call as a self-reporter, the execution of a prison sentence is central. That is a different question than whether a judge properly assessed the accusation. First check the entire summons letter: which punishment, which institution, which date and which contact details belong to this notification? DJI's information for self-reporters explains the preparation and the limited possibility of a postponement request. A practical problem with the reporting date must be assessed along that route. (information from DJI for self-detectors)

If there is a simultaneous legal dispute about the enforceability of the sentence, discuss this separately with a lawyer. Don't assume that an objection you wrote down in a regular letter will stop execution by itself. The same applies to a telephone conversation in which you only explained that the date was inconvenient. Ask what procedure is actually running, what decision is needed and what the existing call means in the meantime.

The receipt date must be verifiable

DJI mentions a period of seven days after receipt of the call letter for very urgent, unforeseen circumstances. Therefore, keep not only the letter, but also what is available about receipt. Distinguish between the date at the top and the date you received the letter. Ask questions about a term immediately and do not wait until all substantive appendices are complete before seeking legal help.

A missing envelope or unclear delivery does not need to be replaced by a self-chosen date. Describe honestly what is known and which documents support it. Ask how additional information should be provided and how you can receive confirmation of receipt of a submitted request. The handling of a late request requires your own assessment; a good substantive reason for postponement does not automatically answer the individual question of why a request was not made in a timely manner.

Inconvenience and an unforeseen emergency are not the same

Almost every prison sentence has consequences for work, housing and family. Precisely for this reason, a general overview of those consequences does not automatically substantiate exceptional postponement. Make it clear which event occurred unexpectedly and why it could not be accommodated within the existing preparation. A work obligation that has existed for some time requires a different explanation than an acute change that takes place after the call.

The quality of the substantiation lies in the connection between facts. When did the situation arise? When did it become clear that it would affect the reporting date? Why is your presence necessary at that moment and what other solution has been investigated? Avoid strong words without explanation, such as indispensable or impossible. A contact person who briefly confirms the factual situation can be more informative than an extensive self-statement that only emphasizes the seriousness of the problem.

Ask for a specific period with a clear goal

A request is easier to assess when it contains a defined period and a recognizable purpose. A wish for later provides little information about what the postponement solves. Describe what event or necessary transfer must take place within the requested period and why the problem will be different afterwards. If that is still uncertain, make that uncertainty visible instead of coming up with a precise end date.

Also note the difference between an actual need and a desired planning. It can be understandable to want extra time to say goodbye or arrange work. This means that the exceptional grounds are not automatically present. The DJI information for self-reporters can help distinguish the general preparation for detention from a separate deferment request. Have legal assistance assess whether the requested purpose fits the applicable procedure and which supporting documents are relevant. (DJI information for self-detectors)

Describe the necessary care without making medical conclusions

In an acute care situation, it must be clear what practical role you actually have. Think about who needs help, what care has already been organized and where a specific temporary gap exists. A medical certificate must come from an appropriate source and must not be misrepresented beyond what it actually says. Summarizing a diagnosis, necessity or medical expectation as a professional judgment makes the substantiation less verifiable.

Share sensitive medical data only to the extent necessary for the review and through an appropriate route. If necessary, ask what limited explanation is sufficient. The purpose is not to distribute the complete file of a family member in an enforcement proceeding. At the same time, a general appeal to privacy is no substitute for necessary factual substantiation. Discuss with legal assistance how both interests can be reconciled and what alternative confirmation is available.

Investigate what can be organized without delay

A request is not made stronger by leaving every other solution undiscussed. Map out whether a transfer, alternative care or other practical arrangement is possible and where it gets stuck. This shows which problem the postponement is specifically intended to solve. An alternative may be insufficient because an instance has no place or a necessary action cannot take place until a certain date. Indicate the source and date of such information.

Investigating alternatives does not mean that you have to pretend that everything is easy to arrange. A concrete description of a missing option can be useful. Make a distinction between a solution that you find unpleasant and a solution that is actually unavailable. A judicial or administrative review is more useful than that difference than a list of general concerns about what detention means for everyone.

Fictional example: unexpected loss of informal care

In a fictional example, Bas has to report on a set date. Shortly after receiving the call, the other caregiver of a family member in need of care unexpectedly drops out. Bas initially writes that he is the only one who can help. This leaves important questions open: which tasks should be taken over, what temporary assistance has been requested and how long will it take before a replacement scheme is actually available?

A better substantiated request contains a timeline of the new event, a brief factual confirmation, the alternatives examined and a specific requested period. Even then there will be no automatic allocation. The fictional example shows that personal involvement and a legally convincing substantiation are different things. For example, a confirmed transfer of care on a nearby date may result in a different request than a request to stay at home indefinitely.

Separate submission, receipt and decision

Use the contact details and instructions from the current call and official DJI information. Save what was actually submitted, including attachments and shipping information. Note when additional information was requested and sent. A reference to an old telephone number from an unrelated letter may delay treatment. Ask specifically which authority decides and how the decision is communicated.

The Code of Criminal Procedure contains the legal framework for enforcement. In the event of a rejection or no decision, a lawyer must assess which legal route is possible and appropriate. An additional letter, complaint or telephone call does not automatically have the effect of a formal decision. Also ask explicitly what is expected of you on the existing reporting date while a request is ongoing. Silence or an acknowledgment of receipt is not a promise that you can come later.

A request that links event and resolution

Create a compact set that makes the exception visible. A long collection of private documents without explanation does not automatically make it clear why a postponement is necessary. Include a brief overview of facts, sources, missing information, and the requested decision. Indicate where the substantiation contains an expectation instead of a given. This prevents an uncertain future plan from being presented as a guaranteed solution.

  • Call: full letter, institution, reporting date and contact details.
  • Reception: known receipt date and available information about it.
  • Event: What changed unexpectedly and when it became known.
  • Necessity: concrete tasks, persons involved and appropriate confirmation.
  • Alternatives: Researched Solutions, Responses, and Actual Limitations.
  • Period: requested duration, intended purpose and remaining uncertainties.
  • Procedure: submitted request, acknowledgment of receipt, additional questions and decision.

Preparation remains necessary when the outcome is uncertain

A postponement request does not automatically reconsider the sentence itself. A pardon is also a different procedure with its own conditions and effect. Do not confuse these routes because they can all influence detention. If in doubt, have it determined which legal problem you want to solve: the start date, enforceability, a ruling or a request based on another legal basis.

Our conclusion is practical: make the exceptional event and the intended solution verifiable, have urgent deadlines assessed in a timely manner and keep the applicable reporting agreement explicitly visible. In the meantime, work on the normal preparation that remains necessary even in the event of rejection. The guide to self-reporting for a prison sentence covers that preparation more broadly. A careful request does not guarantee a postponement, but prevents an important assessment from having to take place solely on general terms and unclear dates. (self-report for a prison sentence)

Questions from litigants

Frequently asked questions

Is loss of work enough to postpone detention?

That does not follow automatically. DJI describes a limited option in very urgent circumstances that could not be taken into account. Have it assessed which concrete unexpected situation exists and which substantiation and alternatives are relevant.

Can I skip the reporting date while my request is pending?

A request or acknowledgment of receipt does not automatically give permission to come later. Ask what the existing call means in the meantime and have any urgent ambiguities immediately legally assessed.

From what date does DJI calculate the aforementioned seven days?

DJI mentions receipt of the call letter. Save the letter and available receipt details and ask for help immediately if anything is unclear. Do not adjust the receipt date to fit the desired result.
