Applying for a Dutch pardon: how it differs from a new trial
After the final verdict, a sentence may encounter a new reality: serious illness, a major care situation or circumstances that were not known to the judge in the same way. Then the demand for pardon may arise. That is not a new trial about guilt and not a general escape route from a disappointing sentence. Our analysis: describe exactly what has changed compared to the ruling, why it is relevant to the implementation and what evidence exists for this. In the meantime, check separately whether the sentence has actually been suspended.

Pardon is about the sanction imposed
Justis's explanation of pardon describes the reduction, change or remission of a penalty or certain measure imposed by the criminal court. The conviction will therefore not be treated as an evidentiary matter again. This distinction determines the preparation. Anyone who mainly states that a witness lied may have a question about a legal remedy or review. Anyone who states that the current implementation requires a different judgment due to special circumstances is asking a question that can be examined within the pardon framework. (Justis's explanation of grace)
So first ask what problem you want to solve. A late call, incorrect registration, desired payment arrangement and substantive question of innocence are not automatic requests for clemency. A targeted choice of procedure prevents a lot of personal information from being collected while the wrong authority is contacted. A lawyer can help determine which route suits the specific problem. The name pardon sounds broad, but the legal function is defined. A request does not become stronger by adding every conceivable objection to the entire criminal case.
The legal grounds require a comparison with the previous decision
Article 2 of the Pardon Act mentions special grounds, including a circumstance that the judge did not or could not take into sufficient account and that would have led to a different sentence, or the lack of a reasonable purpose for further execution in the legally described situation. These standards require more than a list of difficult circumstances. Compare the existing statement and current data and describe which change or missing circumstance is really the core.
The comparison must be fair. A permanent job that the judge expressly took into account is a different matter than a new medical development after the ruling. A repetition of a previously weighted argument does not automatically make it new. Sometimes the relevant question is precisely how an existing circumstance has essentially changed. Describe that process with data and evidence. The aim is not to accuse the previous judge of not knowing the future, but to substantiate why the legal exception option could apply in this concrete situation.
Not every sanction and every moment is appropriate for grace
The general Justis information and the current application route specify conditions for processing a request. A ruling must be final; ordinary legal remedies belong to a different phase. A legal definition applies to fines. Ask your own sanction whether a pardon is possible and which waiting period or exceptional situation must be assessed. An old explanation of one type of punishment should not be applied to every monetary obligation without scrutiny.
Therefore, create a sanction card with the public prosecutor's office number, ruling, date of irrevocability, imposed sanction and parts already carried out. A Public Prosecution Service punishment order is not a judicial sentence that automatically falls under the same pardon procedure. An obligation to pay compensation or other secondary decision can raise its own question. Have the exact legal nature determined before you only enter a fine on a form because it concerns a monetary amount. The application starts with the original decision and its legal basis.
A personal explanation requires verifiable substantiation
Describe the special situation in a clear timeline. In the case of a medical development, it may be relevant when the condition arose, what functional consequences exist and what information a practitioner can responsibly confirm. The question is not only whether someone is ill, but why that would be relevant to the execution of this sentence within the pardon framework. Sending a complete medical history is not automatically more useful than a specific, current and verifiable explanation.
The same applies to work and care tasks. An employer can describe the work and the consequences of absence; a care provider can say something about necessary support. Make general ratings and factual information recognizable. For example, a letter stating that someone is indispensable asks for an explanation of which alternatives have been investigated and why they are actually inadequate. This preparation does not promise grace. It helps to seriously assess the question of exception rather than merely repeating the understandable interest of the convicted person in avoiding execution.
Use the current form and appropriate representation
Justis describes how a request for clemency is submitted, digitally or using the appropriate form. Check that the application is complete, the sanction involved is recognizable and the necessary supporting documents have been added. Keep a copy of the request and any attachments submitted. It is more difficult to respond to a question about missing information later when it is no longer clear which version was actually shipped. Also note receipt and further correspondence.
If someone else takes care of the request, the representation must be arranged correctly. A family member who sends a letter out of concern is not automatically authorized to perform every procedural act on behalf of the convicted person. Ask what authorization is required. Additionally, discuss what sensitive information the representative will receive. A practical request for help and full access to medical substantiation are not automatically the same. Good submission means that the content as well as the authority and data sharing are recorded in an understandable manner.
The previous judge has an important advisory role
The Justis -explanation of the assessment describes how to obtain judicial advice and, where applicable, information or advice from other authorities. The new circumstances are linked to the previous criminal decision. The advice is not a new regular criminal hearing in which every piece of evidence from the main case is dealt with again. The procedure has its own purpose and decision-making. Let the lawyer explain what information is required and which questions are better suited to a different route.
A convincing request makes it clear to the advisor why the current situation deviates from the previous starting point. This may also mean that a less far-reaching change is substantiated instead of requiring complete remission. Ask what result is legally and factually requested. A request that only mentions understanding may leave it unclear what should happen with the sanction. Accurate substantiation provides a question that is easier to assess, without being able to predict the judgment of the advisor or decision maker in advance.
Do not wait for a decision that does not halt implementation
An application for pardon does not have automatic suspensive effect in all cases. The Code of Criminal Procedure and the applicable implementing rules have separate provisions for this. Ask explicitly what status applies to your request and whether a request for suspension or suspension is necessary. A confirmation of receipt does not automatically mean that a call to report will no longer be necessary. A hope for postponement discussed by telephone does not provide the same certainty as a current decision on implementation.
Take each execution letter with you to the lawyer and immediately report an approaching date to the authority handling the request. A personal situation may be urgent, but urgency must be explained with concrete information. Please continue to check what currently applies while a separate request is still being assessed. Anyone who delays themselves on their own authority can cause a new problem. The purpose of the substantiation card is therefore twofold: to carefully present the pardon question and to provide an understandable answer to the implementation status.
Fictional example: a new healthcare situation after the ruling
In a fictional example, Tessa receives a permanent custodial sentence. A few months later, a serious accident involving her partner created a new long-term care situation. Simply saying that the family needs her does not clarify the basis for pardon. The lawyer therefore maps out the ruling, the origins of the situation, the necessary care and the alternatives examined. It is also examined whether another implementation provision is appropriate. The question of pardon is one possible route that must be legally demarcated.
In the meantime, Tessa saves her call and explicitly asks whether execution will be suspended. The fact that the family collects documents is not an exemption from reporting. The example does not predict grace in caring tasks. It shows what makes a changed circumstance verifiable: a clear date, concrete consequences and reliable information about why the existing principle needs to be reconsidered. Personal seriousness deserves attention without automatically meeting every legal condition.
A map from changed data to requested decision
Organize the request around the gist, not the amount of attachments. For each new piece of information, state what the difference is with the situation during the statement and why this is relevant for the execution. Reference an existing piece with date and provenance. When something is uncertain, show it. An application can be supplemented with clarification where necessary, but a collection of unverified personal statements does not automatically provide the decision maker with a reliable picture.
- Sanction: ruling, public prosecutor's office number, irrevocability and implementation to date.
- Grounds: concrete legal basis for pardon to be assessed.
- Comparison: what did the judge know and what is essentially different now?
- Facts: timeline, reliable confirmation and relevant limitations.
- Alternatives: investigated solutions and reasons why they are insufficiently suitable.
- Request: desired reduction, change or remission with reasons.
- Execution: current calls, separate suspension question and written status.
Pardon does not erase the conviction
Justis explains that a pardon does not alter the ruling and notation in the judicial documentation as such. This is in line with the distinction with which the preparation began: the sanction can change without the determination of guilt being annulled. Anyone who actually wants to correct an incorrect registration has a different question. Anyone seeking a new substantive assessment of an irrevocable conviction must have the possible revision route assessed separately. The procedures are not each other's replacement forms.
Our conclusion: pardon requires a precise exception question, embedded in a reliable comparison with the previous decision. Understanding difficult circumstances is important, but substantiation and actual implementation remain separate tasks. Use the self-reporter guide when a detention call comes up and discuss each response with the attorney. A careful request does not guarantee an outcome. It does make visible which special circumstance must be assessed and what is actually expected of the convicted person during the procedure. (guide to self-detectors)
Frequently asked questions
Can I still have it proven that I am innocent with a pardon?
A pardon is not a new trial regarding the finding of proof. This concerns reduction, modification or remission of the sanction within its own legal framework. An innocence or new evidence issue requires separate assessment of the appropriate remedies or review options.
Do I not have to report while the application is pending?
Don't assume that. A request for clemency does not automatically suspend execution in all situations. Have the current status checked and request a separate suspension or suspension if necessary. An acknowledgment of receipt is not the same decision as a granted postponement of execution.
Will my criminal record disappear if I am pardoned?
Pardon does not automatically change the conviction and its entry in the judicial documentation. It's about the sanction. A registration or VOG question has its own framework. Therefore, have it determined exactly which consequence you want to have assessed and which procedure applies.
