When a compensation claim is not heard in the criminal case

After a criminal case, a victim hears that the claim for damages is inadmissible. This can feel as if the judge is saying that the damage does not exist or that what happened was not serious. That meaning does not follow automatically. The decision may be related to the possibilities of the criminal trial, the relationship to the proven offense or other conditions for treatment. Our analysis: first read which part of the claim is not being processed for what reason. Only then can it be assessed which next step is useful. A general referral to the civil court is not a detailed plan for evidence, costs and deadlines.

The legal term must remain with the correct part

Declaration of inadmissibility means that the claim, or part thereof, is not settled in the normal substantive manner in those criminal proceedings. A rejection is a different kind of decision. The precise consequences require reading the entire statement. Therefore, start with the dictum, the decisive part, and place the reasoning next to it. A verbal summary in the hallway can miss important differences. Even a short news item about a conviction usually does not provide sufficient information about individual damages, interest or legal costs. Request the real decision before determining a follow-up strategy.

Make a distinction between the position of the victim and that of the Public Prosecution Service. An inadmissible claim for damages is different from an inadmissible Public Prosecution Service in the prosecution. In those situations, the same word does not say the same thing about the further criminal case. The decision on punishment or measure is also a separate part. A victim can be disappointed about several aspects at the same time, but the options for responding to them do not fully coincide. An overview per decision helps to prevent a general wish for an appeal from overshadowing the specific question about the damage.

Why the criminal court does not fully deal with every claim for damages

The conditions for handling a claim as an injured party are included in Article 51f and Article 361 of the Code of Criminal Procedure. This includes the relationship with the criminal offense and the limits of treatment in criminal proceedings. Which reason applies in your own case must be clear from the ruling. Do not automatically assume that the judge found the damage too complicated. Sometimes the discussion lies with another condition, the representation or the connection of a post with what has actually been proven.

That reason determines what needs to be prepared next. A complicated damage calculation may require additional evidence or expertise. A missing authorization requires another check. A discussion about the connection with a proven event may again require an assessment of liability and causality. It is therefore not very efficient to send all original documents again to the same authority without reading the motivation. Ask for each reason what information is missing, what procedure can handle that question and whether a legal remedy or new civil step is appropriate.

A disproportionate burden is not a value judgment about the victim

Article 361, third paragraph, of the Code of Criminal Procedure provides a provision when handling the claim places a disproportionate burden on the criminal proceedings. This procedural law consideration does not mean that the suffering is too small or the victim is too difficult. A criminal case has its own purpose and structure. A question of damages may require more research or debate than can appropriately be conducted. At the same time, complexity is not a word that automatically makes every insufficiently explained decision understandable. Read what substantiation the judge provides and which part of the damage is actually affected.

Our analysis is that this distinction is also emotionally important. A victim who understands exclusion as personal rejection may give up further evidence gathering. Conversely, the thought that the civil court will automatically award can lead to further disappointment. That judge must assess liability, damage and other defenses within its own framework. The declaration of inadmissibility does not constitute a payment title for the remaining amount. The follow-up therefore requires a new substantive and practical assessment, with the previous decision forming an important part of the available file history.

A mixed decision requires a breakdown

One claim can contain several items: a direct expense, income damage and non-material damage, for example. The judge can decide differently on these parts. Therefore, put the requested amount and the outcome per item next to each other. Note where it is granted, rejected or declared inadmissible and what has been determined regarding interest and costs. A total amount at the bottom of the claim does not make such differences visible. Payments already received must also be recorded separately, so that a follow-up claim does not unintentionally present the same damage again in full as unreimbursed.

Moreover, a partial award is not the same as the finding that all other damage is substantively unfounded. For this, the motivation must be read again. In the event of a rejection, a substantive judgment may have consequences for the possibility of raising the same claim again later. This requires specialist advice before it is assumed that the entire original claim is still open indefinitely. The practical benefit of a breakdown is therefore not only in calculations: it prevents three legally different outcomes from being treated as one missed payment.

Save what the criminal judge actually received

Collect the original joinder form, additions, appendices and any responses from the defense. Check which version was submitted and which posts were subsequently changed. A personal work file with additional damage does not prove that the judge had that information. Also note whether anyone acted on behalf of the victim and what authorization was involved. The procedural explanation of Rechtspraak helps place the roles within the criminal case. For the damage question, it is especially important that the follow-up care provider knows what has already been assessed, disputed or has been procedurally unclear. (procedure explanation of Rechtspraak)

In addition, keep original supporting documents about the damage and make visible what each attachment supports. For example, an invoice proves an amount charged; payment, necessity and connection may raise separate questions. A medical document can substantiate consequences without establishing full legal causality itself. Let sources speak within their own reach. This prevents missing substantiation from being filled with conclusions that the author did not provide. A new file becomes stronger by addressing those gaps in a targeted manner than by just making the old folder more extensive.

The civil route requires its own feasibility assessment

If a claim can be brought before the civil court, it must be assessed what is required for this. Liability, damage and causation can be examined within civil law; Relevant damage provisions can be found in Book 6 of the Dutch Civil Code, among others. Which procedure is appropriate, which representation is needed and which costs or legal risks apply depend on the case. A referral in the criminal judgment is not an automatic start of civil proceedings. Someone has to prepare the step and take it in the right way. (Book 6 BW)

Also discuss the practical recovery options, without them completely replacing the legal claim. A convincing claim does not automatically result in actual payment. Existing insurance, previous attachment or other payments may be relevant and should be checked on their own terms. Don't incur costs based on a blanket promise that a won civil case will pay for everything. Ask in advance for an explanation of the required proof steps, possible counterarguments and realistic implementation. In this way, an understandable need for recognition is linked to a concrete plan, with a view of what the next procedure can solve.

The victim does not have the same legal position as the suspect

An injured party has its own options within the criminal process and in subsequent steps. She cannot simply institute every criminal legal remedy in the same way as the suspect or the Public Prosecution Service. For example, the information from the Supreme Court for victims and injured parties shows that cassation has its own conditions and terms. Therefore, immediately assess which route suits the decision received. Taking over a standard term from another party may be incorrect. Also note when the ruling and follow-up information were actually received or became known.

A civil claim also has its own questions about limitation and possible interruption. Do not assume unlimited time because the criminal case is still ongoing or because the judge refers to another procedure. Have the specific timeline legally assessed, even if additional medical or financial information is first required. A conversation with a supervisor does not automatically replace a required action towards the other party. Agree who will monitor the deadline and ask for confirmation of the step taken. This allows the substantive file to be supplemented without the procedural position becoming unnecessarily uncertain.

Fictional example: three items, three different consequences

In a fictional example, Amina claims compensation for broken glasses, lost income and other costs incurred. The judge grants one post, substantively rejects another and declares the remainder inadmissible because further investigation is too burdensome for the criminal proceedings. Amina just remembers that she doesn't get everything. An advisor first makes a breakdown of the three decisions and reads the reasoning. This makes it clear that the untreated remainder does not have the same legal position as the substantively rejected post.

For the possible civil follow-up, original documents and missing substantiation are collected, while legal remedies and deadlines are assessed separately. A payment that has already been received is also noted. The fictional example does not predict a civil award and does not provide an amount that would be appropriate in a real case. Above all, it shows why a next step cannot be derived from one total sum. Only when it is clear by post what has been decided can it be responsibly discussed which investigation, which legal argument and which procedure are required for the remaining dispute.

Seven questions after receiving the verdict

Read the card with someone who can assess its legal meaning and include the original decision. Do not enter a follow-up route if it is still uncertain. An open question with a responsible person and response date is more useful than an assumed possibility that later turns out not to exist. In addition, use a payment overview to keep amounts already received separate from allocations that have not yet been made. The map helps the transition from disappointment to a concrete inventory of what still needs to be decided or investigated.

  • Statement: date, instance, full text and current process status.
  • Item: amount claimed, relevant attachments and final version of the submitted claim.
  • Outcome: granted, rejected or inadmissible, with separate mention of interest and costs.
  • Reason: procedural condition, substantiation, connection or disproportionate burden according to the real motivation.
  • Addition: missing documents, expertise and the specific point that can be investigated.
  • Follow-up: possible response or civil suit, own term, representation and feasibility.
  • Payment: compensation already received, other routes and check for overlap or outstanding execution.

A claim that has not been processed requires a legible follow-up question

Our conclusion is that a declaration of inadmissibility only becomes understandable when it is linked to the reason and the damage item involved. The term does not automatically mean that there is no damage, but it does not guarantee success in a subsequent procedure. A careful file brings together the ruling, original substantiation and remaining questions. This helps the victim make an informed choice about legal protection, further evidence and a possible civil action. The most important first step is therefore to read exactly what the judge has and has not decided before the entire amount is claimed again.

The injured party and compensation guide provides the broader context. In the case of violent or sexual crimes, a Compensation Fund application may also be relevant under its own conditions; this compensation does not automatically replace the recovery of damages. Have the routes and possible confluence assessed separately. This means that the follow-up approach remains focused on the actual problem: which claim is still open, which substantiation is lacking and which appropriate procedure can provide a substantive answer to this? Questions from litigants

Frequently asked questions

Does inadmissible mean that my damage does not exist?

Not automatic. The reason may lie in the possibilities or conditions of treatment within the criminal case. Read the motivation and operative part by post. A substantive rejection is a different decision and may have different consequences for the future.

Does the civil case start automatically after the criminal judgment?

No. A possible referral to the civil court is not an automatic start of the procedure. Have it assessed which claim can be made, which documents and representation are required and which term or limitation question requires attention.

Can I claim the entire amount again?

That should not be taken as a general rule. Split assigned, rejected and unhandled portions and track payments. The significance of a previous substantive decision and any overlap must be assessed before a new claim is drawn up.
