Prison leave in the Netherlands: purpose and supporting documents
A family event, treatment appointment or preparation for return can be a reason for wanting to go outside temporarily during detention. However, there is not one general right of leave with the same conditions for every prisoner. Type of leave, legal position, behavior, safety and interests of others may differ. Our analysis: an application is easier to assess when it describes a concrete activity and shows how it can be carried out responsibly. Simply saying that someone is staying indoors for a long time or that support is available at home does not answer who should decide, what arrangement applies and which practical agreements have actually been confirmed.

The application must match the detention title and leave form
The legal basis for temporary abandonment lies, among other things, in the Penitentiary Principles Act and the Temporary Leaving of the Institution Regulations. The applicable options differ depending on position and regime. A detainee in pre-trial detention, a convict in an ordinary institution and someone under a special measure are not automatically comparable. A previous favorable decision by a fellow detainee also does not provide personal consent. Ask the case manager or lawyer which route applies to your own situation and what information is required for a formal assessment. (Penitentiary Principles Act · Regulations for temporarily leaving the facility)
First distinguish between the desired activity and the legal name associated with it. A person may want to go to a family address, but the purpose may be a serious personal incident or preparation for return. These differences influence the application. An incorrectly chosen form or general name makes a request that is understandable in itself more difficult to process. Therefore, state what actually needs to be done outside and why it is necessary now. Then have the competent employees indicate the applicable regulation, without taking an assumed right based on an old story as a starting point.
Reintegration leave requires a demonstrable purpose
DJI describes reintegration and leave as part of the preparation for return. This may include behavior during detention, safety risks and victim interests. A concrete activity can focus the conversation: an agreement about housing, necessary preparation for work or another appropriate step within the applicable framework. The purpose must be in line with the applicable leave form. Not every wish outside the institution automatically becomes an activity that fits within the conditions because of the word reintegration. Have that connection explicitly assessed before further agreements are announced as firm.
Substantiate why physical presence is necessary and whether the goal can also be achieved in another way. An online contact or representation may be an alternative in some situations, while elsewhere a personal appearance is really necessary. Describe that factually. Ask a receiving organization to confirm the appointment, duration and contact person without promising leave on behalf of DJI. Our analysis is that a plan becomes stronger when the necessity and practical implementation match. An attractive future story without a concrete agreement is more difficult to test than a limited but confirmed activity.
Occasional leave has a different reason
Occasional leave can arise in the event of special personal circumstances, such as a serious family incident. Which events and conditions are covered must be checked based on the scheme and your own situation. An understandable wish to be present is not automatically sufficient for every form of unescorted departure. Ask what supporting documents are required, what decisions will be made regarding duration and supervision and who will process the application. In an acute event, rapid information may be required, but speed does not make the assessment and necessary consent redundant.
A loved one can help with specific confirmation of event, location, date and contact person. As a precaution, do not share a family member's entire medical record if a more limited confirmation can answer the relevant question. Agree how additional questions will be answered through an appropriate channel. The willingness of a family to pick someone up does not independently decide on guidance or transport. Keep a provisional practical proposal recognizable as a proposal. This prevents an urgent emotional moment from becoming more complicated later due to agreements that have already been treated as consent without an authorized decision.
A good plan also takes risks and others into account
A leave request must be able to show how the activity is carried out responsibly. Consider address, route, accessibility, people involved and possible confrontations that must be avoided. A contact or area restriction remains an individual obligation and does not disappear because an appointment is important. Therefore, have the plan tested against existing conditions. The position of victims and other involved parties requires concrete attention without approaching them directly to arrange consent when this is not appropriate or permitted. The appropriate route for such interests should be followed.
Describe problems honestly. If someone lives at the desired address with whom no contact is permitted, this must be discussed in advance. If a receiving person is only available at certain times, this is part of the planning. An application is not stronger because risks are omitted and later come true by chance. A realistic alternative or clear precaution can show that the activity has been seriously prepared. The decision remains with the competent authority, but the applicant can ensure that the relevant facts and possible solutions are verifiable.
Permission, times and changes must remain together
When leave is granted, the concrete decision and conditions determine what is possible. Check departure and return, permitted purpose, address, guidance and reporting arrangements. A verbal message that it will probably work out is not an equivalent substitute for the required consent. Tell recipients which agreements actually apply, without suggesting extra space. In case of uncertainty, clarification must be requested in a timely manner. Your own broader explanation because traffic is busy or an appointment is overdue can have consequences for the implementation and later assessment.
Also prepare common disturbances. What happens when transport is unavailable, an organization moves the appointment or the leave address is unexpectedly unavailable? Ask in advance who can be reached and how a change should be reported or approved. Save relevant confirmations. A necessary phone call can make a problem visible, but does not automatically constitute a formal change to all conditions. So let it remain clear which decision has changed and which obligation still applies. A small practical contingency plan can prevent an approved activity from sparking a new discussion through improvisation.
There will be a specific temporary opening in 2026
The decision in Government Gazette 2025, 39911 opens up a temporary option for reintegration leave for extramural work from January 1 to December 31, 2026, in accordance with the rules stated therein. The decision also contains a provision regarding leave already granted after that period. This is a specific legal opening, not a general right for every detainee to go out earlier due to capacity problems. The conditions of the scheme and the individual decision remain necessary. Therefore, check both period and category before invoking this option.
This workaround shows why source versions matter. An article from last year may mention an end date that has now been changed by a new decision, while a future proposal is not yet an applicable extension. Save the scheme used and decision date in your own folder. Ask which version applies to the application and whether special transition rules apply. A case manager can help find the relevant route; the lawyer can assess a legal ambiguity. A general message about a shortage of cells does not replace that individual check and does not provide a specific departure date.
The decision maker helps determine the appropriate route
A rejection must be read in terms of content, authorized decision-maker and the stated options for contesting it. The RSJ explanation on appeals in the prison system distinguishes, among other things, appeals after a complaint decision and certain direct appeal options in ministerial decisions. There is therefore no universal objection letter that has the same function for every leave decision. Let the lawyer immediately assess the appropriate route and short term. Do not automatically adopt the standard administrative law period of six weeks in a detention procedure with its own rules. (RSJ explanation of prison professions)
A complaint about speed or treatment can be in addition to a substantive procedure, but does not automatically replace it. If an event occurs quickly, it must also be examined whether an appropriate emergency route is possible and what can be expected from it. Simply indicating that it is urgent does not change a refusal into consent. Save the application, decision and proof of receipt and note which date is essential for the activity. This allows a targeted assessment of whether the objection concerns the motivation, the actual implementation, the lack of a decision or another element.
Fictional example: a work appointment without confirmed times
In a fictional example, Jonas wants to attend an appointment with a future employer during detention. The employer says in general terms that he is welcome, but has not yet confirmed a contact person and time period. Jonas already calls that an approved working day at home. Preparation shows that it must first be determined which form of leave is suitable, what information is required and how the agreement can be implemented. A wish, an employer invitation and a granted leave decision are three different steps. Confusing this creates expectations that the file cannot yet support.
With help, the purpose, location, accessibility, transport and available times are made concrete. An existing area restriction is also checked. The fictional example does not predict an award. It shows that a small amount of precise information can add more than an extensive letter about motivation without practical agreements. If the employer subsequently changes the date, it must be reconsidered what is permitted and what confirmation is required. Previous permission does not automatically apply to every future appointment with the same organization or for a longer stay outside the institution.
Seven components for a verifiable application
Keep the plan short and connect each piece of information to a real confirmation or explicit open question. Agree who monitors mail and changes, so that the family and the receiving organization do not each use a different version. The map must also show which parts can only be finalized after approval. A preparation document is not a leave certificate. Use it to provide the competent decision maker with sufficient information and, after a decision, to understand exactly what has been granted, what conditions apply and where a practical change requires further consultation.
- Route: detention title, form of leave, applicable regulations and competent decision maker.
- Purpose: concrete activity, reason for physical presence and connection with the legal framework.
- Appointment: address, date, time slot, receiving contact person and confirmation.
- Safety: relevant restrictions, interests of those involved and practically appropriate precaution.
- Implementation: transport, guidance, accessibility, return and contact in the event of disruption.
- Decision: written consent or rejection, exact conditions and current version.
- Follow-up: additional information, change request, appropriate legal protection and monitored period.
A good leave plan makes wishes and possibilities concrete
Our conclusion is that leave during detention requires more than an understandable reason to be outside. The activity must fit in with the legal route and can be carried out in a practically responsible manner. This makes source version, decision maker and real agreements as important as motivation. A careful plan does not promise a favorable decision, but helps the substantive assessment take place. It also provides clarity after permission, when the precise times, conditions and contact routes become important. A small ambiguity that is discussed in advance does not have to overshadow the entire leave afterwards.
The Conditional Release Guide covers a different transition from detention and should not be used as a leave arrangement. Discuss your own application with the employees and lawyer involved and keep the original decision in the plan. Temporary measures, individual circumstances and the regime can influence the possibilities. The joint question remains concrete: which activity is requested, under what regulations can it be assessed and which confirmed agreements make any leave granted responsibly feasible for all involved? Frequently asked questions
Is every prisoner entitled to leave after a fixed period of time?
That cannot be promised generally. The form of leave, detention position, arrangement and individual assessment are decisive. Check the applicable conditions and your own decision. A favorable experience of someone else or a general calculation date is not personal consent.
Is an invitation from family or employer enough?
An invitation may provide relevant substantiation, but does not grant leave. The competent authority must decide in accordance with the appropriate procedure. Make the purpose, location, times and contact person specific and do not present a provisional plan as an already approved departure.
Can I send the same objection letter to every rejection?
No. The correct complaint or appeal route depends, among other things, on the decision and decision maker. Short terms may apply. Have your own letter assessed immediately and discuss in the event of an upcoming event whether a suitable emergency route is possible.
