Withdrawing an appeal: when is that a conscious choice?
An appeal can feel different over time than it did on the day of the verdict. Perhaps the costs or burden are greater than expected, the personal situation has changed or the original goal seems less important. Withdrawal may then be a subject of consultation. However, it is not an optional pause: a legally valid withdrawal can end the possibility of submitting the same appeal again. First, the scope, consequences and possible appeal by the Public Prosecution Service must be clear.

Why the original choice can be discussed again
A lot can change between the filing of an appeal and the hearing. Treatment begins, work disappears or the suspect wants an end to uncertainty. These are understandable reasons for a new conversation. They do not automatically determine what is the best legal or practical choice. Start with the appeal: which decision did you want to see changed and what uncertainty still exists about that outcome? Without that starting point, short-term relief can obscure the view of definitive consequences.
Our editorial analysis is that a withdrawal decision deserves a brief written consideration. Not to force the client to litigate, but to make visible what goals are being given up and what obligations may follow. A verbal feeling that the matter may now be finished does not constitute a clear order regarding a specific legal remedy. Discuss the full verdict, trial status, and execution. Avoid a general letter in which different matters and decisions are mixed up.
Withdrawal may make the judgment final
Article 453 of the Code of Criminal Procedure attaches to withdrawal a waiver of the right to use the legal remedy again. The Supreme Court emphasized in ECLI:NL:HR:2020:437 the importance of a clear and unambiguous withdrawal. This is therefore not an ordinary administrative agreement that can simply be revoked. The consequences for the decision becoming final must be discussed with the lawyer. (Article 453 Code of Criminal Procedure · ECLI:NL:HR:2020:437)
That line is not an invitation to gamble on unclear formulations. Those who really do not want to withdraw should not use text that appears to do so. Anyone who wants to withdraw must know to which case and which legal remedy the order relates. A subsequent disagreement about the meaning of a letter can be complicated and does not provide a general guarantee of recovery. Therefore, ask for an explanation of the consequences in advance and confirmation of the action taken afterwards.
The Public Prosecution Service may have its own procedural interest
Check whether the Public Prosecution Service has also lodged an appeal and whether that appeal is still pending. Your own withdrawal does not automatically cancel that appeal. Treatment can therefore continue while the suspect thought that everything would end because of his letter. Moreover, the Public Prosecution Service's grievances may have a different purpose than its own objections. Ask which facts and decisions can be reassessed as a result.
A verbal impression that the Public Prosecution Service probably no longer has an interest is not a confirmed withdrawal by the Public Prosecution Service. Have the registered status checked. Also note whether there are multiple cases or related procedures. A personal appeal against a judgment and a separate question about criminal seizure or other decision should not be treated as one package without explanation. The lawyer can indicate which procedural act exists for which part and what its termination does and does not do.
A partial wish can be interpreted differently
Someone may want to stop discussing a car, but want to continue the appeal against the sentence. Your own letter stating that the appeal is withdrawn can then be read more broadly than intended. It was precisely such an interpretation problem that arose in the case that led to the judgment of March 24, 2020. The Supreme Court assessed the comprehensibility of the judgment on the clarity of the withdrawal; that judgment does not provide a general possibility to reverse every withdrawal. (the judgment of March 24, 2020)
The practical lesson is not to use a self-invented limitation without legal control. What can be formally limited depends on the legal remedy and the case. A wish to no longer discuss only one sanction is not automatically a legally valid partial withdrawal. Have the lawyer explain the assignment in understandable language and indicate how it relates to the formal act. Check case number and date so that an instruction does not end up in another procedure.
The process moment determines which route still exists
The information from the Judiciary states that the appeal can be withdrawn until the case has been declared by the messenger. The legal regulations and specific procedural status must be checked. After the start of the treatment, the situation is different than before it started. A wish to no longer litigate may then require a different legal assessment. Do not assume a general right to end the procedure at any time with an email. (information from the Judiciary)
Therefore, please contact the lawyer in a timely manner if withdrawal is being considered. Don't wait until just before the hearing because the action seems simple. Authority, authorization and processing must also be correct. A sent request is not yet a verified confirmation that the appeal has been withdrawn. As long as it is unclear what has formally happened, calls and existing obligations must continue to receive attention. Ask what attendance and preparation remain necessary if a decision on withdrawal has not yet been finalized.
What changes for punishment, conditions and payment?
Read the full judgment on the consequences of becoming final. There may be more to come than the main punishment you withheld. Consider a conditional part, special conditions, a compensation measure, criminal seizure or a criminal driving ban. The performance has its own rules and starting times. Your own desired commencement date in a withdrawal letter does not automatically determine this. Ask what messages to expect and which authority is responsible for implementation.
A retraction can also influence the scope to affect the content of the statement later. This possibility should not be confused with a practical question about a payment arrangement or an implementation agreement. Costs, treatment and work may be important in the consideration, but do not give a general right to change a final sentence as desired. Let the lawyer compare the procedural and implementation consequences before making a decision.
A realistic comparison between continuing and stopping
Contrast the intended benefit of continuation with uncertainty, costs and tax. Ask what information is still missing to make a responsible decision. Perhaps the full verdict or position of the Public Prosecution Service is needed first. Perhaps the appeal goal has already clearly changed. A careful discussion does not necessarily have to lead to continuation, but also not to withdrawal. The goal is an informed choice that fits the actual process position.
The cost information about appeals can be a starting point for the financial conversation. Ask the lawyer what work has already been carried out and what will follow. The price of legal assistance does not determine the legal outcome, but unclear costs can create unwanted time pressure. Also distinguish between emotional exhaustion and a concrete desire to give up the legal option. Both deserve attention, but they are not necessarily the same instruction. Fictional example: two appeals and one general letter
Suppose that Pieter appealed against a sentence and a seizure decision in a fictitious situation. He also has another criminal case pending. After consulting with family, he mainly wants to end the discussion about the object. He writes that he is withdrawing all his appeals. Such a formulation can reach far beyond its original purpose. The example shows why the identification of the case and the legal possibility of limitation should be discussed before shipment.
The lawyer first asks Pieter which outcome he really wants to give up and checks which appeals exist. It is also examined whether the Public Prosecution Service itself has filed an appeal. This is followed by an explanation of the actions that are or are not possible. The final instruction is tailored to the specific case and the action taken is confirmed. This care is not a formality: it prevents a practical desire on one subject from being unintentionally recorded as a waiver of a much broader legal position.
What if a letter has already been sent?
In the event of a possible incorrect revocation, contact the lawyer immediately. Save the sent text, the receipt data and previous communication about the intention. Describe what you wanted at the time and what that description is based on. A new letter stating that you have changed your mind does not automatically cancel a legally valid withdrawal. The question of whether the original action was clear and valid must be distinguished from simple retrospective regret.
Also have it checked what the registry has registered and what process decision may follow. Don't ignore a call because you assume a recovery message will solve everything. The judge may have a role in a dispute about the withdrawal; the precise route requires legal assessment. The 2020 judgment underlines the importance of the concrete context, but does not create a general recovery button. Fast, factually correct communication is therefore more important than a firm conclusion about validity.
A note before the revocation order
Use the following points as a conversation aid and let the lawyer take care of or check the formal action. The note is not a withdrawal statement and should not be sent as such. Its value lies in making its purpose, scope and consequences visible. If a part is unknown, it must first be discussed whether that uncertainty can responsibly remain in the decision.
- Case: which judgment, which date and which number does it concern?
- Legal remedy: which private appeals exist and what scope has been established?
- OM: has an independent appeal been filed and what is the current status?
- Objective: What change was sought and why is it now being abandoned?
- Consequence: which decisions can become final and what implementation will follow?
- Instruction: is the assignment clear, case-specific and given with an understanding of the consequences?
- Confirmation: what formal action has been taken and what document confirms it?
Frequently asked questions
Can I simply resubmit a withdrawn appeal later?
In principle, a legally valid withdrawal entails a waiver of that authority. A recovery option cannot be universally promised.
Does the case end if the Public Prosecution Service has also lodged an appeal?
Not automatic. The profession of the Public Prosecution Service has its own existence and must be monitored separately.
Can I write that I am only withdrawing the discussion about the punishment?
First check what can be formally restricted. A substantive wish and a legally valid partial withdrawal are not the same.
