Driving license & traffic

The OM does not decide whether your driver's license will be withdrawn

If your driver's license has been confiscated and you have not received a letter, every day can be heavy. However, not receiving a letter does not automatically mean that no decision has been made. First it must be determined when the driving license was actually confiscated by the police and what period applies. This is followed by the question of what the Public Prosecution Service has decided and how restitution will be carried out. This article helps to substantiate those questions with documents and concrete data.

No post is not the same as no decision

Anyone who has lost their driver's license understandably keeps an eye on the mailbox. However, a late letter can have various causes: the document has not yet been processed, the decision has been made but not received or the decision has not actually been made in time. These options require different next steps. Therefore, do not start with a general conclusion about the Public Prosecution Service's error, but with a factual status question that mentions the relevant documents and data.

Our editorial analysis is that a collection calendar should contain two timelines. The first concerns legal actions: surrender, confiscation of the driver's license and decision. The second is about communication: sending, receiving and inquiry. Anyone who merges those lines may incorrectly use the date of receipt of a letter as the decision date. Conversely, a timely decision can remain unclear if no one checks its implementation. A good overview keeps both questions separate and leaves unknown parts visible.

Request for surrender and actual confiscation of the driver's license

The Public Prosecution Service instruction regarding confiscation of the driving license emphasizes the distinction between the demand to issue the driving license and actually obtaining it. The starting point for the statutory ten-day period is the actual confiscation of the driver's license. It is therefore not always correct to calculate from a telephone request, a check during which the document has not been issued or an announcement remembered later. The specific course of events and registration must be investigated. (OM instruction regarding confiscation of driving license)

Find the receipt received and any correspondence regarding subsequent surrender. Note whether the document was submitted at the audit, at a desk or later by post. In the event of loss or theft, the instruction may describe a special procedure; this must not be equated with ordinary physical surrender without verification. Ask the lawyer at which point in your situation qualifies as confiscation of your driver's license. A self-chosen earliest date is not a reliable legal starting point just because it leads to a more favorable outcome.

Ten days requires a controlled calculation

Article 164 WVW 1994 contains the regulation and the Public Prosecution Service instruction mentions restitution if a decision on whether to retain the driving license for a longer period has not been made within the statutory period, in accordance with the General Term Act. The public information from the Public Prosecution Service explains, among other things, the situation in which the tenth day falls on a weekend or on a public holiday. Therefore, do not use a calculation that automatically treats every calendar in the same way. (Article 164 WVW 1994 · OM statement · public information from the Public Prosecution Service)

Have the start and end dates checked with the relevant documents. A calendar app can count days, but does not determine which legal rule applies to the starting point, public holidays or the specific action. Also note whether it concerns making a decision or receiving the letter. That distinction is essential to the question of whether the Public Prosecution Service acted in a timely manner. Ask which source of evidence shows the decision and its date and what information still needs to be requested.

Ask specifically for decision and registration date

An effective inquiry mentions the case number, the collection details and the specific request for confirmation of the decision taken. Ask when a decision was made on whether to retain the driver's license for a longer period of time, what duration was determined and how the decision was sent. Keep the explanation received and request a copy of the decision if it is missing. The goal is not just to hear that the case is pending, but to understand what legal status currently exists.

Use official contact channels and do not share unnecessary data with an unknown caller or intermediary. A lawyer can link the status question to a specific request about restitution. Make a difference between an answer from an administration and a formal decision. An employee saying something is likely on its way doesn't necessarily confirm that all restrictions have ended. Therefore, note exactly what has been confirmed and what question remains open, rather than using a reassuring summary as final status.

If a decision has not been made in time

If an inspection shows that a decision on whether to retain the driving license for a longer period of time was not taken in a timely manner, the question of legal consequences must be linked to the legal regulations and the current situation. The OM instruction mentions this as grounds for restitution. Let the lawyer formulate the conclusion with the correct starting point and the term calculation. A general accusation that nothing has been heard for too long is less precise than a request that substantiates the relevant actions and dates. (OM statement)

A discussion about the time limit does not mean that you can accept the absence of a driving restriction and start driving. Implementation, the document and other possible limitations should also be checked. The criminal case also does not end automatically because the driver's license cannot be retained for a longer period of time. The traffic behavior can be dealt with substantively later. Therefore, keep the request for the driver's license back and the defense against the suspicion visible as separate parts of the consultation.

Distinguish between request to the Public Prosecution Service and complaint route

The Public Prosecution Service page on restitution describes the petition and complaint. Which route is appropriate in your current situation depends on the decision received and the procedural situation. A status question is not automatically a complaint. An earlier request on personal grounds does not necessarily replace a targeted response to an established deadline error. Ask the lawyer which goal is paramount and which authority decides on this. (OM refund page)

Keep copies and receipts of each step. If a summons for a criminal hearing or public prosecutor's hearing has now been received, the lawyer must know this. The authorized destination and preparation may be related to this. A form letter found only on the Internet may miss important current information. Indicate the existing decision, the concrete dates and the request, without presenting an individual outcome as if it had already been confirmed by the competent authority.

Fictitious example: three dates and a wrong addition

Suppose that in a fictitious case a surrender request is made on Monday, the driver's license is only surrendered later and the driver receives the withholding letter later. He counts from the first Monday to the day of receipt and concludes that the decision is always made too late. This calculation interchanges the possible starting point, the decision date and the receipt date. The example shows why all three must be determined separately before drawing a term conclusion.

The lawyer therefore requests proof of the actual confiscation of the driver's license and the decision. The legal term is then calculated using the relevant calendar rules. If a deadline problem appears, a specific request will be made with that substantiation. If a decision has been made in time, it can still be discussed whether the longer retention of the driving license should continue for other reasons. The example is not a prediction that a late letter is always unimportant. She can demonstrate a communication or implementation problem that requires a different specific question.

Also substantiate an independent interest in return

A term study can be in addition to personal circumstances. Therefore, collect current information about work or care if necessary, but keep the legal purpose separate. An employer's statement does not prove a decision date. A correct term calculation does not prove which care tasks the driver performs. Each argument gets its own source. This makes the request easier to assess and prevents a weak point in one part from making the entire preparation unclear.

Describe transportation alternatives honestly. A loan car does not solve a driving disability. A temporary driver may be able to take over some of the work, but not every early care task. Establish those boundaries with concrete times and confirmed assistance. Share only the necessary personal information of others. The lawyer can determine which documents fit into the request and which information is better left out of the file. The intention is to provide proportionate substantiation, not to collect the largest possible collection of private data.

After a return decision, checks remain necessary

For a favorable decision, ask where the driver's license is, how it will be sent or collected and when it will actually be available. The Public Prosecution Service states that driving is not permitted as long as the returned driving license is not yet in hand. Also check any CBR decision or other driving restriction. A refund notification from one procedure does not automatically undo that other status. The extended driving license has not yet been received after a favorable decision, this will work out. (OM states that driving is not permitted as long as the returned driving license is not yet in hand · Your driving license has not yet been returned after a favorable decision)

Save the decision and implementation information. If the shipment is not forthcoming, ask specifically about that practical problem instead of just fighting the original issue of holding on to the driver's license for longer. Describe which decision has already been made and which part has not yet been implemented. A lawyer can thus contact the right authority and prevent inquiries from continuing to move between different departments. Until driving status and document are clear, transportation should be arranged without driving on an unconfirmed assumption.

A two-track collection calendar

This editorial worksheet helps to separate legal actions and communications. It is not an automatic term calculator. Fill in the data with their sources and have the legal calculation checked. Mark an expected date as forecast and an unknown date as unknown. This makes it visible which question can be resolved with a document and which legal assessment is still required.

  • Surrender claim: what was requested, when and which document describes it?
  • Withdrawal of driving licence: when did the document actually arrive at the competent authority and what does this prove?
  • Term: which starting point and which application of the General Term Act have been checked?
  • Decision: date, content, duration and copy of the decision.
  • Communication: dispatch, actual receipt, inquiry and confirmed responses.
  • Request: what formal step has been taken and where is receipt recorded?
  • Execution: document returned, status checked and other driving restrictions assessed separately?
Questions from litigants

Frequently asked questions

Does the term always start at the traffic control?

Not always. The actual confiscation of the driving license and any special situation must be determined. A previous demand for surrender may be a different time.

Does a late letter prove that the Public Prosecution Service decided too late?

Not automatic. The date of the decision and the date of receipt are different data. Request the decision and relevant registration.

Can I drive once I have counted ten days myself?

No, don't assume that. Have the term, decision, implementation, document and any other restrictions checked.
