Driving license & traffic

Car seized and driver's license confiscated: two separate questions

If both the car and the driver's license are taken in a traffic case, it feels like one event. Legally, however, they can be different measures, with their own goals, decision makers and routes to request restitution. A favorable decision about one object does not automatically free the other. This in-depth helps to organize the basis, rights holder and practical consequences for each object.

One traffic stop, two legal questions

The driver's license relates to the authorization and document to drive. The car is an object subject to criminal seizure. These measures do not necessarily have the same basis or duration. For example, a car can be held for investigation or a possible later decision about the object. The driving license can be confiscated and withheld by the police according to the Road Traffic Act. One route should therefore not be treated as a blanket solution for both.

Our editorial analysis is to create two object maps directly. The first contains the driver's license, the confiscation of the driver's license and the withholding decision. The second shows the vehicle, the seizure ground and the possible rights holders. Common facts may be relevant to both maps, but the requests remain distinguishable. This prevents an urgent need for the car from being submitted in a procedure that only decides on the driver's license, or from a car being returned while the driver wrongly thinks he can drive again.

Why is the vehicle subject to criminal seizure?

The Public Prosecution Service's explanation of criminal seizure mentions various goals, such as finding the truth and securing a possible later asset decision. The Code of Criminal Procedure contains the legal regulations. Ask which grounds are used in your case and which authority will decide on continuation or restitution. A criminal seizure is not always the same as a practical relocation or towing measure. Read the document received and check what actually happened. (Public Prosecution Service explanation about criminal seizure · Code of Criminal Procedure)

Locate the receipt or notice. Make a note of the license plate number, identification details, date and contact authority. If no piece is available, ask how it is obtained. A verbal indication that the car is in judicial custody (bewaring) may not be precise enough. For a targeted request, it must be clear what interest the criminal seizure still serves. The general guide to criminal seizure and return discusses the basis of requests and the complaint, with its own requirements and deadlines. (criminal seizure and return)

The confiscation of the driver's license involves a personal assessment

Article 164 WVW 1994 is relevant to the driving license and the OM instruction describes the treatment of confiscation of the driving license and the longer retention of the driving license. Check the actual collection moment and the withholding decision. The fact that the car is with the police does not prove that a decision on the driver's license has already been made in a timely or substantively correct manner. Conversely, returning the driver's license does not mean that any grounds for seizure of the car have disappeared. (article 164 WVW 1994 · OM statement)

Discuss with the lawyer which route is now required for each part. The OM page about driving license return uses a different framework than a general seizure request. A common background can be mentioned in the explanation, but the desired decisions must be recognizable. For each card, note the competent authority, step submitted and receipt. A telephone question about the car is not automatically a complaint about the longer retention of the driver's license. (OM page on driving license return)

Owner, license plate holder and user are not always the same

A vehicle can be registered in someone else's name, leased or purchased with financing. The financial position then requires attention. The vehicle registration alone does not tell the full ownership story. Gather relevant purchase, lease or financing documents and describe who will use the vehicle. Let the lawyer determine which limited documents are needed and which third-party data does not need to be distributed.

A third party who claims to be the owner may have his own interest in return. This does not automatically mean that the criminal seizure is unlawful or must end immediately. The grounds for seizure, third party rights and possible subsequent decisions must be assessed. Also ask who is authorized to make a request and what power of attorney is required. A driver cannot exercise all rights over the vehicle on behalf of any financier or employer without explanation. Therefore, keep the different roles recognizable in the correspondence.

Describe what problem is causing the lack of the car

A car may be needed for work, transport of materials or care. But if the driver is also not allowed to drive, the relevant interest may be that another authorized person can use the vehicle. Describe who that is and why this particular vehicle is needed. A general statement that the family cannot live without a car provides less guidance than a timetable, vehicle function and substantiated lack of an alternative.

Do not give the false impression that returning the car will solve the driver's license problem. A loan car also does not help the driver if the driving restriction persists. Another authorized director may be practically relevant, but that does not automatically remove the grounds for seizure. The lawyer can link the personal or business interest to the assessment of the continuation of criminal seizure. A factually correct description of partial alternatives is better than an absolute statement of necessity that is contradicted by one's own situation.

Ask in a timely manner about storage and possible disposal

criminal seizure does not mean that a car is kept unchanged indefinitely. The OM information describes that objects subject to depreciation can be sold under certain conditions and also discusses destruction. This can be drastic for someone who expects the vehicle back. Therefore, ask early what management decision has been made or considered and who can be contacted about this. A request for return does not automatically stop any other action with the vehicle. (OM information)

Describe a special interest in preserving the specific object in a concrete and timely manner. An emotional value, specific design or business function may require a different substantiation than just the desire to maintain the sales value. Let the lawyer assess which procedure or urgent question is necessary. In a situation that has now been sold, a later favorable decision may take a different form than the return of the original vehicle. That possibility is part of the consideration and should not only be discovered at the end of the case.

Fictional example: a company car with a different driver

Suppose that in a fictitious case an entrepreneur has lost his driver's license and the company car has been confiscated by criminal law. An employee does have a valid driver's license and can perform some of the work. The practical importance of the car does not exclusively consist of the transport of the entrepreneur. The request must show who is allowed and able to use the vehicle, which assignment is at a standstill and how the company is legally involved with the vehicle. The example predicts no return.

The lawyer asks separate questions about the longer retention of the driver's license and the criminal seizure of the car. Ownership, work and a concrete replacement option for the car are being investigated. For the driver's license, the decision and the traffic law grounds are assessed. A favorable outcome on one card is not used as an answer to the other. This way, even after a decision has been made, it remains clear which action is still necessary and who can responsibly organize which transport until then.

Read the magnitude of a favorable outcome

If a car is allowed to be returned, ask who can pick it up, what documents are required and whether there are any other obstacles. A message about return is not always the same as actual delivery. If the driver's license is allowed back, check the document and other driving restrictions. The implementation of both decisions may lie with different authorities. Keep the written documents so that an inquiry does not always have to start with the original event.

In the event of a rejection, the motivation must be read per object. An investigation interest in the car may require a different follow-up than a fixed driving license detention period. Let the lawyer assess which legal remedies or new requests are possible and within what period. Sending the same emergency letter again to all departments involved is not automatically the correct route. A concrete response to the soil used provides more guidance for a subsequent assessment.

Inform lease, insurance and work separately

A criminal seizure can also raise contractual questions for a leasing company, insurer or employer. These relationships have their own framework. Provide factual information in a timely manner where necessary, but do not automatically forward the complete criminal file. Discuss which notification or limited confirmation is appropriate and who is authorized to communicate. A contractual obligation to report something does not automatically mean permission to distribute all data of other data subjects.

Also ask what obligations are ongoing, such as lease payments or a replacement appointment. A criminal request does not automatically decide these contract questions. The lawyer can indicate whether additional expertise is required for a component. It helps to also keep this third card separate: in addition to the car and driver's license, there is sometimes an agreement with your own party and your own terms. This way, a favorable trial decision is not wrongly seen as a general solution for all financial consequences.

A file card per object and authority

The overview below is an editorial aid for preparation. It does not replace a formal request or legal remedy. Keep original documents and your own summary separate and enter unknown data as an open question. This focuses the conversation on the decision that is actually necessary and on the authority that is competent.

  • Object: driver's license or vehicle, with identification and proof received.
  • Ground: What authority and purpose are alleged for this object?
  • Right holder: owner, user, license plate holder, lease or financing position.
  • Importance: concrete consequences, authorized alternative user and missing solution.
  • Management: location, storage, possible sale or destruction and confirmed information.
  • Procedure: appropriate body, formal step, deadline and acknowledgment of receipt.
  • Implementation: what has been decided per object, who can collect and what other restrictions remain?
