CBR -not being able to pay costs: discuss the consequences in a timely manner
A mandatory CBR course or an examination can have a heavy financial burden, especially if you earn less due to the driving license problem. However, a payment obligation does not automatically disappear due to a lack of funds or an objection to the measure. Costs have different components and a missed deadline can trigger an independent new decision. This depth helps you ask the right questions before the due date and monitor payment problems, objections and driving status separately.

A financial problem can become a second legal problem
A driver can end up in a circle: less income without a driver's license, difficulty paying due to less income and a new disability due to non-payment. That is a real practical problem. Legally, however, it must be distinguished which decision already exists and which consequences are attached to non-cooperation or non-payment. An appeal to the financial circle is not automatically an exception to the applicable rules. That is precisely why the problem must be reported early and specifically.
Our editorial analysis is that affordability and procedural control should sit side by side. A discussion about the correctness of the measure may be necessary, but does not automatically protect against a second decision due to a missed payment. Therefore, create two lines: substantive dispute and compliance as long as the decision applies. This classification prevents someone from creating a new, more difficult to repair situation out of conviction that the CBR is wrong, without requesting specific legal advice about it.
Imposition costs and implementation costs are not the same
For a course, a distinction can be made between the costs of imposing and implementing. An investigation also has its own costs and instructions. The National Ombudsman explains in CBR measures that the same payment options are not available for every item. An arrangement for one component therefore does not mean that all accounts are covered by the same agreement. Read each invoice and the decision, including the amount, reference number and due date. (National ombudsman explains in CBR measures that the same payment options do not exist for every item)
Ask by post whether a payment arrangement, postponement or other option exists and under what conditions. Don't automatically adopt an assumption from an old case or another course type. A request does not constitute a granted arrangement. Save the written confirmation and check whether it contains the correct invoice and term. If only implementation costs are mentioned, the question about the other item remains open. A personal partial payment does not automatically prove that the remaining payment has been deferred according to a valid agreement.
Objection is not automatically a pause button
The general rule from the General Administrative Law Act is that an objection does not automatically suspend the operation of a decision. In the case of a CBR measure, it must therefore be checked which obligations continue to apply in the meantime. An objection can challenge the legal correctness, while payment and cooperation require attention in the meantime. Anyone who waits for a favorable outcome without a valid suspension or confirmed appointment may create a new basis for intervention. (General Administrative Law Act)
Discuss with the lawyer whether a request for interim relief is necessary and possible in addition to an objection. This applies to its own conditions, including urgent interest and an ongoing procedure. A request for such a provision also does not automatically mean that the decision has already been suspended. The concrete judicial decision must be awaited and read. The guide to objections to the CBR covers the basics. Payment problems must also be worked out practically with the right authority. (objection against the CBR)
Non-payment may be treated as non-cooperation
The Road Traffic Act 1994 and the regulations on driving skills and suitability measures contain obligations and consequences for non-cooperation. The payment obligation may be part of this. An invalidation due to late payment is then a different decision than the original decision that imposed the course or research. That second decision deserves its own reading and, if necessary, its own legal remedy assessment. (Road Traffic Act 1994 · regulation on driving skills and suitability measures)
It is not responsible to say that financial impotence is always accepted or that any late payment immediately restores the status. Ask which rule is applied to the specific item and which recovery route exists if a decision has already been made. Keep new posts separate in the timeline. An old confirmation of receipt of an objection to the measure does not automatically indicate that a later declaration of invalidity has also been challenged. The lawyer must know both decisions and their own deadlines.
A ruling from 2026 shows the separate decisions
In ECLI:NL:RBROT:2026:10362, the preliminary relief judge assessed an EMD measure and a declaration of invalidity due to unpaid imposition costs. The ruling describes postponement and reminders, after which the costs had not yet been paid. The request for a preliminary injunction was rejected. It was a provisional judgment; the judge stated that this does not bind the court in any substantive proceedings. The personal payment problems did not remove the applicable obligation in that specific assessment. (ECLI:NL:RBROT:2026:10362)
The editorial lesson is not a general prediction that every financial argument is futile. The case does show that the original measure, the obligation to pay costs and the subsequent driving status can form separate decisions. A director must therefore not only discuss the correctness of the course, but also the specific invoice and expiration date. A request for assistance that is only made after a second decision can result in a different and more complicated legal position than timely consultation about an ongoing payment obligation.
Report the problem with amounts and a realistic proposal
If payment fails, please contact us through the official channel before the due date. Mention the specific invoice and ask what options exist for that item. Describe what is and is not feasible, with a realistic schedule. A scheme that only fits on paper but is not feasible the following month could shift the problem. Also ask what significance the application has until a decision has been made. Do not assume that a submitted request will automatically postpone the original deadline.
Save the confirmation of an assigned appointment and follow the terms carefully. If circumstances change, report this again in a timely manner. Do not put an option promised by telephone in the calendar as definitive without checking it. Ask the employee to confirm the correct reference, amount and new moment. In the event of threatened invalidation or conflicting information, the lawyer must assess the legal consequences. A payment discussion and a legal remedy against a decision are different steps, even if the same financial need is the reason.
Make feasibility verifiable without spreading everything
An overview of income, necessary costs and available space can help to formulate a practical proposal. Use current amounts and state uncertainty. Do not confuse your own budget with a legal capacity calculation: which standards an agency applies must be checked separately. Share only the data required for the specific request and use the agreed secure channel. A complete banking history of family members is not automatically an appropriate first attachment.
If necessary, seek help from debt counseling or other appropriate financial support. This is a practical addition, not a guarantee that the CBR will extend a term or that a legal obligation will lapse. Let the care provider know the specific date and possible consequences. A general process that takes months may be too late for an invoice that is due this week. The financial overview must therefore be linked to the legal calendar, with clear responsibility for urgent questions.
Fictional example: one arrangement and two invoices
Suppose that Jonas receives a confirmed settlement for the implementation costs in a fictitious case. He thinks that this also covers the imposition costs. However, the second invoice has a different feature and is not included in the confirmation. The financial space is limited, but the first check is now which agreement actually applies. The example shows why the word payment arrangement without the accompanying invoice does not provide sufficient certainty.
Jonas places both invoices and the confirmation side by side. He specifically asks for that item before the other due date and discusses the consequences with the lawyer. If an invalidation has already been received, it will be treated as a separate decision. The example does not predict that a postponement will still be granted. It makes visible how an administrative assumption can be prevented by keeping track of amounts, characteristics and terms per component.
A payment is not the same as being allowed to drive again
If a validity restriction already exists, the current status must be checked separately. A later payment or registration for a course does not automatically change that status at the same time. Ask what decision is needed, what other obligations exist and what recovery step has been confirmed. The driving license declared invalid guide discusses why a new document or procedure may be necessary. Don't drive based on a bank debit alone. (driving license declared invalid)
A refund by the Public Prosecution Service can also be placed in addition to a CBR decision. Different authorities decide from their own framework. Therefore, make a list of all pending restrictions and do not treat a favorable message from one route as a blanket release. If there is any uncertainty, the lawyer can ask the correct status question. Arrange work and care temporarily on a confirmed basis so that financial pressure does not lead to a new trip that could cause an additional legal problem.
A cost and correspondence overview
Use one line per invoice and refer to the decision on which it is based. This is an editorial tool and not a personal payment plan. A feasible proposal must be confirmed by the competent authority. Keep the original term visible until a legally valid other agreement or decision is clear. This means that a distinction remains between a request, a promise and a payment made.
- Decision: measure, investigation or subsequent invalidation with its own date and reference.
- Cost item: imposition, implementation or other item, amount and invoice number.
- Term: Original due date and source of any change.
- Request: date, official destination and specific requested arrangement or postponement.
- Confirmation: which post and conditions were actually awarded?
- Procedure: objection, interim measure and any new decision monitored separately.
- Driving Status: What is current and what confirmed recovery step is required before resuming driving?
Frequently asked questions
Does my objection automatically suspend the CBR invoice?
Not by itself. Check which obligations remain in force and whether a separate suspension or confirmed appointment exists.
Is there a payment plan for all costs?
Not automatic. Check the invoice characteristics and which items are expressly included in the confirmed arrangement.
Can I drive again as soon as I pay later?
Don't assume that. The current validity and any recovery decision must be checked separately.
