Subsidized legal aid rejected: objection and payment agreements
A rejection of subsidized legal aid can cause great uncertainty while the criminal case continues. Yet rejected does not mean the same in every situation. There may be a financial problem, information may be missing or another basis may be used. The first step is to read the reason in the decision precisely. The objection, a different application route and the payment agreement with the lawyer can then be assessed separately.

The word rejected is not a diagnosis
Read the entire decision, including the data used, reasons and legal remedies information. A financial rejection requires a different analysis than a decision regarding the nature or necessity of the requested legal assistance. An incomplete application can also have its own follow-up. The exact wording is therefore more important than a summary that someone has remembered by telephone. Ask the lawyer which part of the decision is disputed substantively or factually.
Our editorial analysis is to read a rejection in three columns: what does the Council determine, what rule does the Council apply and what consequence does the Council attach to it? This makes it clear whether the problem lies with a given fact, a legal application or the current situation. It prevents an objection from containing an extensive explanation of a point that is not the reason for rejection. A targeted response does not have to be long, but should touch on the real decision point.
Save the objection position while you request an explanation
The Legal Aid Board describes the objection procedure and mentions a period of six weeks after the date of dispatch of the decision. Use the concrete remedies information and have the applicable starting point checked. A telephone conversation with an employee is not an automatic objection. Asking for an explanation does not automatically extend a period. Waiting for the lawyer without a clear agreement about filing can also cause an unintended gap in security. (Legal Aid Board describes the objection procedure)
Note who provides the formal response, when it is sent, and what acknowledgment of receipt is available. If any documents are still missing, discuss how the term will be handled safely and legally. Your own incomplete message is not the same adequate process action in every situation. Ask for confirmation of what was actually submitted and under which reference. In the case of multiple decisions, each number must be recognizable; an objection to one decision does not automatically protect every other application.
Check factual data and legal opinion separately
Check personal data, case description and financial information used in the decision. An error in a year or outdated information can lead to a specific research question. Place the data used next to the piece that you think contains the correct data. State why both are really about the same person, period and definition. Comparing a net monthly amount with a fiscal annual amount does not in itself demonstrate an error in the decision.
A legal disagreement requires a different substantiation. If the Council believes that a certain form of legal assistance is not covered by the scheme, a new pay slip alone will not help. Ask the lawyer which standard has been applied and why that application is being contested. An objection can have both factual and legal grounds, but these must be recognisably separated. An unfocused pile of documents sometimes makes the core of the difference less visible.
A changed situation may require a different route
If the data from the reference year are correct but the income has since fallen, a reference year change may be relevant. That is not the same as saying that the original tax data was wrong. The current carrying capacity is then mapped out under certain conditions. The in-depth reference year change in a criminal case discusses the comparison of years and the required substantiation. (reference year change · Your income has fallen: reference year change in a criminal case)
Discuss whether an objection, reference year change or a combination of steps is necessary. Each request has its own purpose and term. Do not assume that a new financial form automatically subjects an earlier decision to the correct assessment as an objection. Conversely, an objection letter is not automatically a complete application for assessment for the current year. A good decision map therefore states per route what action has been taken and what decision is still expected.
From frustration to a targeted objection
An actionable ground identifies the decision, the disputed part, the reason and the source. For example: the calculation uses a data for a different period; the attached piece shows which period is relevant; you are asked to reassess that part. This is an editorial structure, not a standard text that fits every case without legal advice. The wording must be consistent with the concrete grounds and the applicable regulations.
Also describe what is not up for discussion. If one amount is incorrect, there is no need to dispute every other piece of information again. A targeted response can therefore be more controllable. Add and number only relevant attachments. Explain what each attachment shows so that the reviewer does not have to guess why a document was included. In the case of sensitive financial or medical information, it is also important which limited data is actually needed for the decision point.
A hearing and a decision on an objection
According to the Council's objection information, a case may be submitted to the Appeals Committee and a hearing may take place. The Council then makes a decision on the objection in accordance with the applicable framework. Not every objection has the same treatment or the same factual questions. Therefore, read invitations and information requests separately and discuss with the lawyer what needs to be added. A previously submitted letter does not automatically make new questions redundant. (objection information from the Council)
Prepare a conversation with the core of the difference and the most important locations. New information must be described recognisably as new. Do not present a current situation as if it had already been determined on a previous decision date. Afterwards, ask what next step is expected and when a decision or message has been promised. If a decision on objection remains unfavorable, further legal proceedings may have their own deadline. Have that new decision checked immediately instead of acting based on the old calendar.
The subsidy and the assignment are separate agreements
A rejection does not automatically mean that the law firm will continue to perform any work free of charge, but neither does it mean that every conceivable invoice is due without further agreement. Read the order confirmation and ask what agreement applies in the event of a rejection. The information requirements for lawyers emphasize clarity about price and additional costs. A subsidy application, a personal contribution and a private assignment may not overlap in an unclear manner. (information requirements for lawyers)
Ask which necessary process actions are being monitored in the meantime. A criminal hearing or appeal period does not automatically wait for the Council. Determine who remains responsible for mail, deadlines and substantive preparation. If other legal assistance must be sought, the transition requires care. An undiscussed financial uncertainty can otherwise result in a misunderstood assumption that the lawyer will continue to handle everything or will no longer do anything. The decision folder and the assignment folder must therefore be linked together.
Fictitious example: correct old data, decreased current income
Suppose Karim receives a financial rejection in a fictitious case. The data used from the reference year is correct, but he has now started earning less. His first reaction is that the Council made a mistake because he cannot pay now. That describes the need, but not yet the precise route. The question may be whether assessment based on the current year is possible rather than whether the old tax data is incorrect.
Karim and the lawyer compare the grounds for rejection, annual data and current forecast. They determine which formal steps are required and monitor the associated deadlines. It will also be confirmed in writing which work will continue in the criminal case and which financial agreement applies. The example shows that an unfavorable decision is not always resolved by one general objection. The correct diagnosis prevents the available time from being spent on an argument that does not actually challenge the original decision.
Prevent multiple decisions from becoming one unclear pile
In a longer case, various subsidized legal assistance, personal contributions or decisions on objections may be available. Save them per characteristic and process phase. Note which activities each request concerns. A decision for an earlier phase does not automatically say what applies to an appeal. Nor does a granted application in one case prove that another application is assessed under the same conditions. The content and current status must remain visible for each decision.
Create a list of open questions and confirmed actions. Indicate when an attachment was submitted and what response it received. A digital upload receipt can be useful, but also check whether the document has been processed with the correct reference. Use official channels and prevent complete financial files from being widely forwarded. A limited, well-organized folder helps both the lawyer and the client to follow the procedure without having to reconstruct everything again and again.
A decision and cost map in seven parts
The format below is an editorial aid for the consultation. It does not replace official instructions and deadlines. Always make it clear whether an amount, date or expectation has been confirmed. An orderly folder does not prove that the objection is successful, but it does make it possible to assess the specific error or change and to clearly arrange the continuation of legal assistance.
- Decision: complete document, reference, date of dispatch and remedy information.
- Ground: exact financial, factual or legal part of the rejection.
- Source: which limited attachment supports the disputed data or changed situation?
- Route: objection, reference year change or other request, each with its own purpose.
- Deadline: Checked entry point, responsible submitter and receipt.
- Assignment: which criminal law activities will continue and which costs agreement applies.
- Follow-up: questions from the Council, hearing, new decision and control of a possible next deadline.
Frequently asked questions
Is a telephone call to the Council already an objection?
Not automatic. Check what formal submission is required and request confirmation of the action actually taken.
Does lower current income solve every rejection?
No. The specific grounds for rejection and the applicable conditions are decisive. A current drop in income may require a different route than combating old data.
Will my criminal case wait until the subsidy has been settled?
Not by itself. Make clear agreements with the lawyer about substantive preparation, deadlines and costs while the financial procedure is ongoing.
