Pro forma hearing: why your case has not yet been substantively dealt with

A hearing date raises the expectation that the judge will now decide on guilt and punishment. However, at a pro forma hearing, the substantive treatment is not yet discussed. Investigation progress, planning and pre-trial detention may require important decisions. The word pro forma therefore does not mean that there is nothing to do. This deepening helps to see which questions are really open and how preparation can be focused on them.

No final hearing does not mean without consequences

The case will not yet be fully substantively dealt with during a pro forma hearing. This may be necessary if the investigation is still ongoing and the case has to be brought to a hearing. The judge can discuss the follow-up and, if pre-trial detention is involved, decide on this. The procedural description of the Judiciary places pro forma and preliminary hearings in the criminal investigation. However, the name of the hearing does not mean that every announced topic is the same in every case. (procedural description of the Judiciary)

Our editorial analysis is that the preparation for such a hearing is often made too narrow. Only asking when the real hearing will finally take place leaves the current freedom decision and concrete research problems out of the picture. Therefore, ask the lawyer what decisions are requested on this date and what information is required for this. A non-substantive hearing can have a very drastic impact on daily life, even if there is no judgment yet on the accusation.

The legal timeline is not a universal calendar

Pre-trial detention is subject to successive decisions and terms. judicial pre-trial detention (Bewaring), detention and the handling of the case belong in their own phase. A simple online addition of days can miss important differences, such as the precise start date, an extension or the investigation that has already started at the hearing. Therefore, use the actual orders and hearing decisions for the timeline. The pre-trial detention guide describes the basics of those phases. (pre-trial detention)

The rule that a case must be brought before a judge on time does not mean that the investigation is always fully completed at that time. This is precisely where pro forma treatment can play a role. Ask which order is in effect, which period is relevant for this and which judge will make the next decision. A family member who keeps track of the days can help practically, but should not communicate their own end date as a confirmed release date. The lawyer checks the legal meaning of the various documents.

Making research progress concrete

An announcement that the research is not yet ready provides little insight into what actually needs to be done. Are digital investigations, witness interviews or expert reports necessary? Who will carry it out and is an expected delivery date known? The answer may be relevant for planning and for assessing progress. Please note that the defense will not receive all investigation information at all times. That limitation must also be recognizable as a limitation.

A progress overview should distinguish between announced research, actual assignments and results received. A report that has been requested is not yet available. A witness on a list has not yet been heard. Note which outcome is required before the substantive treatment can be planned. Discuss with the lawyer what the delay is and what specific question can be submitted to the judge. A general complaint that everything takes too long may be understandable, but does not always make a concrete bottleneck visible.

The question of freedom remains a personal assessment

If pre-trial detention continues, the applicable conditions and grounds must be assessed. The mere fact that an investigation is still ongoing does not automatically justify detention. At the same time, a missing report does not automatically mean that release must follow. Ask what current motivation the Public Prosecution Service gives and what response the defense is preparing for it. Serious objections, grounds and personal circumstances should not disappear in one unspecified argument.

A request for cancellation or suspension requires its own substantiation. In the event of suspension, for example, a confirmed treatment location or an enforceable home address may be important. A previously rejected proposal does not automatically become stronger by repeating the passage of time. Look what has really changed. The lawyer can also assess the significance of the duration of detention and the expected outcome in the specific case. An article cannot provide an individual duration or outcome guarantee. (cancellation or suspension)

The boundary with a preparatory criminal hearing is not always clear

In practice, pro forma and direction topics can come together during the same session. In ECLI:NL:HR:2014:1496, the Supreme Court discussed, among other things, the development of the preparatory criminal hearing and the handling of investigation requests. A label on the call therefore does not replace the question of which requests are actually processed and according to what standard. The timing and substantiation of an investigation request can also be legally important. (ECLI:NL:HR:2014:1496)

Ask the lawyer in advance whether any witness or expert requests need to be prepared. A thought that is only mentioned during a telephone conversation does not constitute a lawsuit request. Describe what the research question is, which decision point is related to it and why the source is relevant. The in-depth preparatory criminal hearing elaborates on this preparation. The aim is that a progress meeting does not pass without a concrete and important research question having been properly discussed. (Pre-trial hearing: preparing investigation requests in a criminal case)

What can the suspect prepare himself?

Make a list of new facts since the previous hearing that may be relevant to a current decision. Consider a changed residence address, a care situation, a confirmed intake or a document that the lawyer does not yet have. Indicate the source and date. Do not automatically give every daily problem the status of a legal argument. The lawyer can determine how the information fits the issues actually presented at the hearing.

Also discuss the process attitude. A pre-trial hearing is not necessarily the appropriate time for an extemporaneous detailed account of the entire accusation. That is not a general recommendation to remain silent, but a reason to understand the function of the conversation. Statements made at that time can also be recorded. Ask how you indicate misunderstanding or a need for consultation. In case of language problems, appropriate interpreter assistance is required to actually follow the questions and decisions.

Fictional example: waiting for a report and a treatment location

Suppose that during a fictitious pro forma hearing it is discussed that digital research will take another six weeks. The suspect has now received an invitation for a treatment intake. The first data says something about the research planning. The second says something about a possible personal alternative. Neither on its own answers all questions about pre-trial detention. Moreover, the content of the digital investigation is not yet known and may not be interpreted as a definitive incriminating or exculpatory result.

The defense therefore checks the progress statement and asks which parts block the substantive planning. Before suspension, it is examined separately whether the intake can lead to actual treatment and how housing and supervision are arranged. After the hearing, the investigation appointment, the freedom decision and the next date are recorded separately. The example shows why one optimistic communication about aid is not the same as a granted suspension request or a confirmed date for the substantive hearing.

Helping family without adding information

Family members can collect documents, confirm practical agreements and support contact with the lawyer, as far as the suspect wants and confidentiality allows. They should not fill in missing file information with assumptions themselves. A rumor about a witness or an expectation from a practitioner is not an official investigation result. Ask what information can actually be shared and what questions the attorney should discuss directly with the client.

A central contact person can reduce practical confusion. Make a note of who requests an employer letter, who can provide an address statement and who keeps the documents received. Avoid a large group discussion in which different versions of the suspicion are exchanged or other involved parties are approached. The purpose of help is to make facts accessible and to implement agreements. It is not the joint construction of a story that would fit a likely outcome of the investigation.

What exactly did the judge decide?

Afterwards it is important to explain the different results. Has the investigation been suspended or postponed during the hearing? What assignment or agreement regarding additional research has been recorded? Has a request for pre-trial detention been granted or rejected and on what grounds? Is the next date final or still a planning? Ask the lawyer to check the wording in the decision or the official report if there is any uncertainty about this.

Also note who takes which next step. A new session can provide an opportunity to monitor progress, but does not replace interim action when a deadline or implementation problem requires earlier attention. Let the lawyer assess whether a legal remedy is possible against a specific decision. Not every procedural decision can be challenged individually and not every route has the same term. Your own log helps keep the questions visible, but the log itself is not a legal remedy.

A timeline without false certainty

Create one sheet per session and refer to the associated documents. Do not mark future dates as confirmed in the calendar until it is clear who determined them. Expectations can also be noted, but with a different label. The log below is an editorial tool to help you understand progress. It is not an official court record or a personal release date calculation tool.

  • In advance: what claim, status of investigation and previous orders are available?
  • Research: which specific assignment is underway, who will carry it out and what date is expected?
  • Defense: which specific question or request will be submitted at the hearing?
  • Freedom: what decision regarding the current order or suspension is requested and made?
  • Planning: which next session or delivery date has actually been confirmed?
  • Execution: who supplies which piece and when is it checked whether this has happened?
  • Check: which decision does the lawyer still need to explain and which possible legal remedy requires immediate attention?
Questions from litigants

Frequently asked questions

Will I be convicted at a pre-trial hearing?

A pro forma hearing is usually not the substantive final hearing. Please check with the lawyer which topics and decisions will be presented at the specific hearing.

Does postponement mean I will automatically remain stuck?

The planning of the criminal case and the decision on pre-trial detention are different questions. Continued retention requires its own legal assessment.

Can I also request a suspension if the investigation is still ongoing?

That could be a subject for discussion. The competent court, the substantiation and the grounds for detention put forward must be assessed in the concrete process phase.

This article provides general information. The rules and options depend on your situation. Discuss your case and possible deadlines with a lawyer.
