A criminal order paid: can you still file a legal objection?
You have paid a penalty and then discover that the decision means more than just a sum of money. Perhaps you dispute the fact, someone else paid or you thought payment was necessary to be able to file a legal objection to the criminal order. Then the question is not only whether you can get the money back. First it must be clear what legal significance the payment has in your specific situation and what steps are still possible.

Why payment afterwards takes on a different meaning
A penalty order can look like an ordinary payment letter. Yet it is a criminal settlement and not a neutral invoice. Anyone who pays to get rid of the post may later be shocked by questions about registration, work or a Certificate of Good Conduct. This makes it important to investigate the legal meaning of payment. However, a feeling of regret afterwards does not in itself prove that the payment was legally involuntary or that the legal remedy is available again.
Our editorial analysis is that the first step should be reconstruction, not a promised recovery path. Who paid, at what time, after what information and with what process history? The answers may differ from each other. A payment by an administration office, a payment after a legal objection to the criminal order has already been submitted and a deliberate payment after legal assistance are not automatically the same situation. Therefore, explain the facts without changing them to the conclusion that a legal objection to the criminal order is certainly possible or certainly impossible.
Voluntary compliance is legally relevant
Article 257e of the Criminal Code regulates the legal objection to the penalty order and the meaning of voluntary satisfaction. The law requires voluntary compliance to include a waiver of the right to file a legal objection to the punishment order. The Public Prosecution Service's penalty notice also discusses payment and legal objection to the penalty order. The mere mention of a protest on a transfer therefore does not provide a reliable general guarantee that the right to contest the decision is retained. (Article 257e Criminal Code · designation of Public Prosecution Service penalty order)
For the assessment it must be clear what exactly the payment involved and whether it should be regarded as voluntary payment. Have an attorney review the facts and applicable rules together. A blog that simply equates every amount paid with a conscious process choice may miss relevant differences. But the opposite message that a simple letter always cancels the payment is also not justified. The law and the concrete circumstances determine which discussion can still be had.
Who made the payment and for whom?
Check the bank statement and ask who ordered the payment. Was that the person to whom the punishment order was addressed, a partner, employer, administrator or administrative employee? Note whether the person concerned knew about the payment and what prior instructions existed. The name of the bank account does not necessarily tell the whole story about the assignment. Therefore, describe not only which account the money came from, but also what demonstrable communication about the payment is available.
Do not make a retrospective statement as if it existed at the time. A current memory may be relevant, but must be identified as a memory. Save existing messages and payment instructions. If an employer processed several traffic letters at the same time, an administration overview can help to reconstruct the route. Do not send personal data about other employees if it is not necessary for the question. The lawyer can determine which limited documents make the relevant facts sufficiently visible.
Payment before and after legal objection to the penalty order are not identical
An important point in time is whether a legal objection to the criminal order had already been filed when the payment was made. The legal regulation of the waiver of the right to make a legal objection to the punishment order and the handling of an ongoing legal objection to the punishment order are not one question without further analysis. An amended criminal order can also change the position. The Public Prosecution Service's explanation about legal objection to the criminal order warns against paying as long as the dispute has not been dealt with and describes what happens in the event of a change. (Public Prosecution Service explanation about legal objection to the criminal order)
Therefore, note the actual filing date, method of filing and receipt of the legal objection to the penalty order. A draft letter on the computer is not a legal objection to the criminal order. A conversation in which you said you disagreed is not equivalent to the correct procedural action without verification. Write the payment date next to it and mention any change letters. This timeline makes it possible to assess the different rules. Without that sequence, a general answer about having paid can be incorrectly applied to another process phase.
Payment and awareness may be related
Familiarity with the punishment order is important during the objection period. A payment can provide information about what someone knew and when, but the circumstances must be precisely reconstructed. It's not enough to just mention the day when you later understood the full legal ramifications. The question of awareness of the decision is not automatically the same as the question of when you realized that a VOG or working interest could be affected.
Save the initial letter, digital mail, reminders and relevant communications. For each document, make a note of when you actually saw it and what you based it on. Your own suspicion about delivery is a different source than a recorded delivery. If the original decision is missing, ask the lawyer how it can be obtained without allowing any remaining term to expire unused. The extended objection period appears to have expired and addresses that time question separately. (The objection period seems to have expired: which facts are important?)
Carefully describe fear of increases and misunderstanding
Someone may have paid because a letter mentions a final payment date or because he fears further collection. That experience deserves a factual description, but does not automatically constitute a legal exception. Ask what exactly was in the letter, what explanation was requested and what answer was received. A general feeling that payment had to be made is less verifiable than a concrete written instruction or a clearly described conversation with the date and authority.
Language problems, dependence on help and unclear communication may be relevant to understanding the situation. Don't exaggerate them or let them serve as a default explanation for every adverse outcome. Make a note of which language you understood sufficiently and who helped with reading or paying. Discuss the meaning with the lawyer. The goal is a reliable representation of the original circumstances, not the formulation of the most favorable possible story that is not supported by the available documents.
Fictional example: an employer pays for a stack of mail
Suppose that a fictitious employer centrally processes traffic mail for a company vehicle. An employee has already filed a legal objection to the penalty order, but the administration pays the amount without knowing this. The employee will later receive a message that the payment has been registered. This situation is not equivalent to a previously discussed choice by the employee to agree to the punishment order after advice. The example does not yet indicate what legal consequences the payment ultimately has.
The lawyer requests the decision, the notice of opposition, the payment order and the existing internal communication. The employer actually describes how the processing took place and whether there were instructions from the employee. No one copies an old instruction afterwards. The applicable rule regarding the ongoing procedure and payment can then be discussed. The value of the reconstruction lies in making the original course of events visible; not in assuming that payment by someone else always leaves a legal remedy open.
Reimbursement is not the same as recovery from the procedure
A request for money back and a legal remedy against the criminal order have different purposes. Even if administrative contact is possible about the payment, this does not automatically mean that the substantive decision is open again. Conversely, a question about the admissibility of a legal objection to the criminal order does not have to be treated exclusively as a banking or debt collection issue. Let the lawyer indicate which formal step is necessary for which purpose and which agency it belongs to.
Also review other consequences separately. The registration of a criminal settlement and a possible VOG assessment require their own rules. Refunding a paid amount does not automatically erase all registrations. A verbal notification that a file is being examined administratively is also not a final court decision. Save confirmations and ask exactly which part has been revised. The terms withdrawn, amended, inadmissible and paid do not have the same legal meaning.
Act quickly without promising an outcome
Seek legal advice quickly after discovering the problem. Please indicate immediately that payment has been made, by whom and if there is already a legal objection to the penalty order. Don't wait until every bank message or envelope has been found. The lawyer can use the available key documents to assess which information is urgent and which procedural action may need to be taken in a timely manner. Collecting evidence is important, but it should not inadvertently serve as a reason to let an available period expire.
After each contact, ask what step has actually been taken and what is still outstanding. A request for information alone does not guarantee that a legal remedy has been initiated. Also have a negative message read exactly: what decision has been made, on what grounds and what follow-up option is mentioned? A disappointing outcome cannot be remedied with a general internet letter. However, a careful reconstruction can prevent a relevant factual detail from being left out of the assessment.
The payment and receipt card
Use the points below to prepare for the first interview. It is not an objection and not proof that payment was legally involuntary. The overview helps the lawyer to link the right rules to the right phase. Add existing pieces, mention missing information and keep your own memories recognizable. This makes it visible what a dispute is actually based on.
- Decision: complete criminal order, number, date and sanction imposed.
- Awareness: when and how did the person concerned see the decision and what does that support?
- Process: had a legal objection to the criminal order already been filed, by whom, how and with what receipt?
- Payment: date, amount, invoice, client and description.
- Circumstances: what existing instruction, explanation or communication preceded the payment?
- Change: has an amended decision or other decision been received?
- Follow-up: which concrete formal step does the lawyer discuss and how is it confirmed?
Frequently asked questions
Can I always pay a penalty order under protest?
Don't assume that. Voluntary compliance may have consequences for the right to file a legal objection to the criminal order. A payment description is not a general guarantee against those consequences.
Does payment by my partner automatically make no difference?
The assignment, knowledge and circumstances must also be investigated. The account holder alone does not decide every legal question regarding payment.
Does my legal objection to the penalty order automatically cancel the payment?
No. legal objection to the punishment order, payment and any change require assessment in their mutual order. Save all documents and have the process position checked quickly.
